The President Observed that the lines on which the nation would progress with the times could not be Left to the individual judgment or passing opinions of a small number of men hoever highly placed they might be particularly when by their age and training such men were far removed from the living realities of the present times and the newer aspirtions of a newer day. [...] Then too the governing factor is the will or the pleasure or it may be the considered opinion of the man or the few men who occupy the seats of power. [...] It is of interest to note that almost simultaneously with the American decision the Judicial Committee declared the bulk of the New Deal " legislation of the Federal Government of Canada to be ultra wires but as yet there has been no re-action in the Dominion of the American kind. [...] But on the present occasion the age of the Lords of the Judicial Committee or their rmoteness from the problems of a modern State has not been advanced as a reason for the advice they rendered. [...] 170 of the Bihar Tenancy Act (same as the Bengal Tenancy Act) if it is not disputed that the decree-holder is the landlord of the tenure or holding and that the decree is for the rent due in respect of it.
