The reason of the rule seems to apply to the steps taken by him after the decree as to the steps taken by him prior to the decree. [...] At the time of the hearing of the suit on the hand-note the hand-note was admitted in evidence. [...] In a summons case omission to explain the particulars of an offence to the accused uler sec 242 of the Criminal Procedure Code And to ask him to show cause at that stage is not (in cases in which the accused is dfended and pleads not guilty) an illegality vitiating the trial provided of course that no prejiXiice can be shown to have been caused to the accused and that the accused has in Jul [...] It cannot be laid down as a general proposition of law that the presumption as to the correctness of an entry in the record-of-rights of a particular land being rent-free i; in every_ case rebutted by the proof that the land is within the permanently settled village of the landlord and is assessed to revenue. [...] It will suffice if at the comencement of the trial the prosecutor brings to the notice of the Court the fact that sue a person is absconding examines a witness witnesses to prove that fact and obtains a direction of the Court that the evidence about to be taken is being taken for the pupose of being used if necessary.
