The present Government of India Act has been enacted in a reactionary spirit because of the refusal of the Congress to accept office in the Provinces and its attempt to make Government impossible by a policy of obtruction both in the Provinces and the Untre. [...] II was argued that the right to rceive compensation is limited to dependants who earn the right at the death of the worman and are in existence at the time of the award to be able to claim it. [...] In -other words if between the death of the workman and the.making of the award the dependant himself dies the right to receive compenstion is extinguished and the representatives of the dependant cannot claim to step into his shoes. [...] The Appellate Court has power to require a party to make good the deileicacy in the Court fee payable by him in the lower Court in cases in which the lower Court has epressly or impliedly decided the question of the category in which the suit ought to be placed for purposes of court-fee but such decision in the opinion of the Appellate Court is erroneous. [...] The Taxing.Officer held that ad valorem court-fees were payable: Held (VENKATASUBBA RAO A. C. J. and HORW1LL J.)—(i) That the passing of a decree in respect of the subsequent profits being in the discretion of the Court (though except for special reasons the Court will not refuse to exercise the discretion in favour of the party) sec.
