We have examined the contents of the book and are satisfied that the statement of the law though brief is accurate and is unencumbered by details. [...] As is well-known the present Indian Act is almost a reprodution of the English Act of 1908 and it is one of the few Acts to the interpretation of which English case-law is not only relevant but idispensable. [...] While the purely legal annotations will assist the lawyer these forms and precdents will be of immense service to the office-bearers officers and share-holders of companies and being of a quality which reveals the expert draftsmen possessing practical knowledge of company work they ought to go a great way towards rectifying the existing looseness and prolixity. [...] The burden of proof rests in the first instance upon him ; in order to succeed he must put the Court in possession of satisfactory evdence as to the quantum of damages to which he is entitled. [...] Where money is paid to another under the influence of a mistake that is upon the supposition that a specific fact is true which would entitle the other party to the money but which fact is untrue and the money would not have been paid if it had been known to the payer that the fact was untrue an action will lie to recover it back and it is against conscience to retain it ; though demand may be
