Year after year we have been pointing out that the Long Vacation of the Calcutta High Court ought to be rationalized so as to suit the convenience of the members of all sections of the legal profession as also the general public. [...] The closing of the High Court by the end August while the Civil Courts the colleges and schools all remain open till the end of thq first week of October means hat members of the legal profession onnected with the High Court are unable avail themselves of the Vacation till then. [...] 21 r. 15 C. P. C. providing that the applicant may apply for the execution of the whole decree for the benefit of all the decreholders and where the Court sees sufficient cause for allowing such application it shall make such order as it deems necessary for protecting the interests of the persons who have not joined in the application. [...] But if he merely applied for execution of a part of the decree and did or said nothing else amouning to waiver bf the rest of his claim then the mere fact of the first piece-meal exection is I submit no bar to the second applcation for execution of the remalncler of the decree. [...] 439 since the proceedings had come to the knowledge of the High Court the priciple upon which the High Court had acted from the outset is that in revision it was necessary in order to get a conviction set asi le to show that it was wrong; ordinarily the Court would not go into the facts at all unless the conscience of the Court has been touched in regard to them.
