If we may say so with respect the desire of the Hon'ble the Chief Justice is entirely in accordance with the feeling of the parties and the necessities of cases of this description. [...] We are afraid in forewarning the parties in the manner indicated the office is assuming the functions of the Bench without any justfication and is indeed acting against the spirit of the direction given by the Hon'ble the Chief Justice. [...] In the circumstances the prfession as a class is still unaware of what the procedure should be and the burden has fallen on the Stamp Reporter of instructing the Advocate for the Appellant in each in-; diviclual case. [...] (3) of that section prvides that the property under attachment although at the disposal of the Government shall not be sold until the claim preferred is disposed of would suggest that the rights of the persons who claim interest in the prperty are to be respected. [...] Under the Hindu law an obligation of a co-parcener to maintain the widow of a dceased co-parcener whose share in the prperty he gets by survivorship is an obligtion which attaches to the property and the widow is entitled as a matter of right to ask the Court to create a formal charge on the property for her maintenance.
