The point involved in each case and the language of the Act bearing thereupon were such that the decision could easily have been the other way: only justice would have been subordnated to the so-called policy of handing over as much as possible of people's debts to the jurisdiction of the Boards. [...] 270 of the Act has unless there is something in the provisions of the Act which suggests a different meaning the same meaning which is given in the defintion of the expression " Servant of the Queen " in secs. [...] There.was no stipulation that the money was to be kept apart or treated as a separate fund by the company: on the Other hand it was paid into the account of the company "with the company's Bank and was used as the money. of the company for carrying on the business. [...] It was agreed that " the amount of the security money would be the second charge on the machinery and the goods of the company ": Held (HARRIES J.)—That no fiduciary relationship was created between the parties and the money was not trust money in the hands of the company. [...] 11 of the Court Fees Act the decree was not complete or capable of being executed until the pament of the court-fee limitation for excution of the decree could run only from the date when the court-fee was paid.
