But as the terms of reference to the Comittee was the determination of boundaries between Bihar and Orissa the Committee ignored the demand of the peoplof Dhabhum and Bengal as outside the scope of their enquiry. [...] Order 21 rule 69 of the Civil Procedure Code provides that the Court may adjourn a sale to a specified day and also that the officer conducting the sale may do so but where the sale is made in or within the precincts of the Court no such adjournment will be made without the leave of the Court. [...] 1 of the Civil Rules and Orders issued by the authority of the High Court in 1935 the procedure of conducting sales has been stated in Rule 234 to the following effect: " At the stated hour. : upon each fixed date the sales shall be commenced and shall be carried on in the order stated in the lists. the sales shall be held from day to day and throughout the day except when the Cour [...] decided that the practice of the Courts under the rules of the High Court which have the force of la* is to place all properties intended for sale on a list; and the sales commence on the day fixed which must go on from day to day till the list is cleared. [...] Both Rule 234 and the ruling dispense with the necessity of obtaining an order of the Court for the purpose of holding the sale in its order on any subsequent day but the Note added to Rule 234 expressly states that the order of the Court must be obtained and recorded in the order-sheet.
