(3) that omission to issue a notice under the rule shall not affect the jurisdiction of the Court in executing the decree. [...] 21 r. 22 is a right under the Code of Civil Procedure and the effect of an omission to issue such a notice has now been reduced to a mere irregularity by that Code a judgment-debtor under a rent decree cannot have any higher right and the effect of the irregularity canot be more serious in the case of a rent sale. [...] Ten persons were named as accused in a charge sheet and the prosecution applied for the separate trial of one of them so as to enable it to examine him as a witness for the pri-Isecution in the trial of the nine others. [...] Secs 235 and 239 of the Criminal Procdure Code which deal with the joinder of charges of different offences and the joint trial of a number of persons are not cotrolled by the latter part of sec. [...] If the Appellant desires to wit'nd'raw and the Court has no jurisdiction to allow him to do so the Court may in a proper case transpose the parties making the Respodent Appellant and the Appellant Respodent.
