The facts established by the evidence of the Manager as also by the evidence of the Sub-Inspector clearly shows that these people were all anti-social elements and were menace to the maitenance of peace and tranquillity in the garden. [...] Although absence of such procedure and silence about the charge in the order dispensing with the service of an employee may raise a presumption against the bona fide of the employers under certain circumstances non-compliance with the prcedure in the present case where the employees have failed to establish unfair labour practice and victimization on the part of the Company and the Company ha [...] The Unions urged that the weight of wrappers should be added to the saleable papers for ascertaining the total production of a year for the purpose of calculation of the production bonus and reference has been made to the scheme of production bonus in the Bengal Paper Mills Ltd. [...] The bungalow servants or the servants employed in the bungalows of the officers are really the personal servants of the officers although they are paid by the Company as a concession to the officers and are not conected in the industry.carried on by the Company. [...] If the Company had paid production bonus to the bungalow servants for two years before the scheme was finalised either as a matter of grace or on a mis Conception of the direction of the Adjudicator the Company was not estopped from withdrawing the grace or rectifying the mistake in the final scheme.
