The issues contained in the schedule of the Order of Reference stand as follows :— (1) Whether the closure of the Company's workshop and offices in Calcutta and its suburbs as from the 17th March 1952 and consequent laying off of the employees was justified and legal.iiZUZ THE CALCUTTA GAZETTE OCTOBER 2 1952 [PART I (2) What redress the employees affected are entitled to? [...] during the pendency of proceedings before the said Tribunal Sri Sudhir Kumar Naskar an employee of the said Company made a complaint in writing before it against the said Company alleging that the said Company had discharged the said workman concerned in such dispute; And whereas in exercise of the powers conferred by section 33A of the Industrial Disputes Act 1947 (XIV of 1947) the said Trib [...] M. R. Metal Works by way of punishment during the pendency of the original proceedings without the permission of the Tribunal and therefore in contravention of the provisions of section 33 of the Industrial Disputes Act 1947. [...] So in the above circumstances I would prescribe the above five scales of pay with the separate scale for the Sircars to govern the cases of the employees of the clerical staff of this concern. [...] When the existing salary is less than the minimum of the grade in question the deficiency should be made up by pulling up the existing wage to the minimum of the grade concerned.
