1879

[...] But in his statement in the log he makes the blow follow a threat on the part of the boy to " cut" the mate and this was at an early period in the course of the altercation. [...] He begins his statement in the log by saying that the boy gave the mate an insolent answer ; that the mate then " shoved" the boy ; that the mate followed after the boy and struck him but he "-couldn't tell where." In court he was able to state that the mate struck the boy in the face and struck him repeatedly. [...] James Roo the third 'deserter' statee in the log that lie heard the mate tell the boy to oil the oars ; that the boy gave the mate some words that the mate when on the poop told the boy to go on with his work. [...] In court however he stated that the mate struck the boy again and again about the face with his fists that he "seized the boy by the neck pulled his Lead out of the boat and hit it against the rails of the boat." The witness was never asked why he did not make these statments in the log.
