the first instance is to involve $95 millions which is the price of a million tons of grain and one-half of it will be in the shape of.grants and the other of credit terms; a further sum of $95 millions divided similarly has a!so been envisaged but only with the fresh approval of Congress. [...] THE CONSTITUTION AND THE COMMUNAL RULE As in the case of the Patna Judgment on the abolition of the zamindari the Supreme Court's verdict on the Madras Government's Communal G. O. has only created a delicate situation with this difference that in the latter case there can be no doubt about the soundness of the constitutional principle as now intepreted. [...] The technical defect arising out of the absence of a member of the Tribunal for a brief period might have been cured by legislation to the effect that such absence will be deemed not to invaldate the terms of the award but apart from the obnxious character of all validating legislation it is doubtful whether a special leave to appeal to the Supreme Court would not then lie on other ground [...] If legislation had taken the different form of embodying the terms of the award it would be legalising priciples which have by no means been acceptable to all sections of the banking business and cannot in any case be rushed through Parliament in the face of the criticisms arising out of the defects noticed in the practical working of the award all these months. [...] This has to be done without prejudice to the discretion of the tribunal to vary any or all of the terms of the award in the light of their working; the hardship caused to the public by the drastic restriction of the business hours should not be the least of the consideations in deciding the issues.
