1 have the honour to request instrutions on the following points :- (1) The duty under Article 25 of the Stamp Act on a counterpart or duplicate is chargeable only when the proper duty has been paid in respect of the original and to ensure this section 16 provides that on production of both the 'instruments and on an application in writting the payment of duty in respect of the original (patta) [...] I and IV and the carrent index sheets may be placed by the Sub-Registrar by a written order in the custoday of the clerk who has furnished security so that the work of the copying and indexing may go on under the personal supervision of the clerk during the temporary absence of the. [...] A reference was made to the Ditrict Registrar who was pleased to pass the following order : - The Sub-Registrar will please register the document on the strength of the power as the bonafide mistake on the part of the Sub-Registrar in authenticating the power in good faith under section 87 of the Registration Act will not invaldate any document registered on the strength of the power." My h [...] There is nothing objectionable in noing the actual payment of the consideration it the presence of the registering officer himself althoug there is no prescribed set formula for such emdorsement as in the case of acknowledgment of receipt of the consideration (Page 370 of the Manual) Section 58 (1) (c) contemplates both pament in the presence of and admission of receipt before the registerin [...] The Sadar office on receiving the same should cash the bill and credit its proceeds as chalan attached add then return the first portion of the chalan to the sub-office thus intimating the credit of the chalan.
