But before such declaration can be admitted it must be proved beyond any shadow of doubt that the deponent is dead that the exclusion of the statement of the deceased will tend to defeat the ends of justice and that the deceased at the time of making the declaration was conscious of the danger or he had the sense of impending death which may be collected from the nature and the circumstances [...] The purpose of S. 162 Criminal P. C. is to protect the accused from being prejudiced by the statements made to the police officer who may be in a position to influence the person making the statement and also to protect the accused from prejudice at the hands of the prosecution witnesses who may be prepared to tell the untruth. [...] The word statement used in s. 162 Criminal P. C. means narration of something to some other person and implies the animus on the part of the author of the statement to commnicate the subject-matter of the statement to the person to whom it is made. [...] If the question were to be put as to the knoledge of the accused solely and exclusively with reference to the law of the land it might tend to confound to the jury by inducing them to believe that an actual knowledge of the law of the land was essential in order to lead to a conviction. [...] Question 5. Can a medical man conversant with the disease of insanity who never saw the prisoner previously to the trial but who was present during the whole trial and the examnation of witnesses be asked his opinion as to the state of the prisoner's mind at the time of the commission of the alleged crime or his opinion whether the prisoner was conscious at the time of doing the act that
