Dispute—existence :—Considering the evidence oral and documentary the tribunal held that disputes existed between the owners and workers of handloom factories in Chirakkal and that the managements had knowledge of them; that therefore the reference of the disputes to the tribunal was valid. [...] Section 10 (2) reads : "Where the parties to an industrial dispute apply in the prescribed manner whether jointly or separately for a reference of the dispute to a tribunal the apropriate Government if satisfied that the persons applying represent the majority of each party shall make the reference accordingly." Rule 16 of the rules enacted under the Act specifies the form pf the applicat [...] We think that this is the immediate and most important of their demands." It goes on to state the position of the trade in regard to profits and finally relies on the fact that the Government had set up a court of enquiry to examine the conditions of the weaving industry in the province and it behoved the labour union to have patience and intelligence to think over those matters calmly when"II L. [...] "They represented to me the difficulties involved in the implementation of the award of the industrial tribunal Kozhikode pertaining to the dispute beween the workers and managements of handloom factories in Kozhikode and in the handloom factories in the Chirakkal. [...] I would therefore allow a cent per cent increase in the wages fixed between these parties in 1940 the same to be the eighth increase to take effect from 4th February 1948 the date of the press release of the Kozhikode award which was comunicated to both these parties who had been told even at the time of the impending strike in the middle of 1947 that the Kozhkode award may bind them 38.
