Mason says - The party may be imprisoned a long time before he shall come to be delivered by the law ; the places of his imprisonment may be in the furthest part of this kingdom ; the Judges always_ made the return of the habeas corpus answerable to the distance of the prison from Westminster ' the Jailor may neglect the return of the first process and then the party must procure an alias or." [...] In the next place I submit that this Regulation ought mrt to have the force of law because it is entirely beyond the scope of the powers conferred on the Legislature.- It is well laid down that if a Statute be open to two eonstructions and the one which is more open be disgraceful to the Crown dangerous to the rights of the subject and hazardous to the connection of India with the Crown ; whi [...] He may also be allowed to see his business servants at stated gimes once or twice in a month in the presence of the Magistratof the Ditrict or the District Superintendent of Police and the officer in charge of the Jail " 3.
