The Land Acquisition Acts Being Act I of 1894 and Act XVIII of 1885 (India Council) With Annotations Connected Acts on the Subject and Important Rules Issued by the Several Provincial Governments

1910

This little volume is intended to place in the hands of the officers legal practitioners and the members of the public having to do with the acquisition of lands the law and the important rules on the subject in a handy shape. [...] Among the matters to be neglected are the degree of urgency which has led to the acquisition the disinclination of the person interested to part with his property and any increase in the value either of the land acquired or of the other land of the person interested which is likely to accrue from the use to which the land acquired will be put. [...] Part V of the Act deals with the payment of the compen► sation by the Collector and provides that in consideiation of the compulsory nature of the acquisition the Collettor shall pay in addition to the amount of compensation awarded whether 140 hiself or by the Court a further sum of 15 per cent. [...] In other words interest should be payable only on any addition which the Court may make to the amount of compensation tendered by the Collector on the amount of compensation by any accident not tendered at the time possession is taken of the laud and on the amount of the costs which the Collector may utimately be ordered to pay to the persons interested. [...] Considering the difficulty almost throughout the country of obtaining the services of such assessors as are really qualified to form a sound opinion on the subject of the valuation oT laud it is believed that the proposal to dispense with them and to leave the matter to the sole arbitrament first of the Collector and then of the Judge will in no way diminish the efficiency oT the Courts in
