EAs there 'vas this day read at the Board a Report from the Right Honourable the Lords of the Judicial Committee of the Privy Council dated the 3oth of May last past humbly setting forth that the Lords of the Judicial Committee have taken into consideration the practice of the Committee with a to greater economy despatch and efficiency in the appellate jurisdiction of Her Majesty in Council [...] Held that the endorsement of the notes by the agents of the payee to the Bank was within the scope of the authority given to theiroby the power of attorney and that the payee could not recover in definite against the Bank. [...] And that in fact the Defendants in pursuance of such power and athority sold and disposed of such Company's paper after the expiration of the period of three months and before the commencement of the suit for their reimbJrsernent of the sum of Rs. [...] In Jauntily 1842 on default niad by A. D. Maleod the three several Company's papers were sold according to the usual course of business and at the market-rate of the day by the Bank in pursuance of the powers contained in the memorandums of deposit after the expiration of the prescribed time in repament of the respective loans. [...] the notes of a transfer under the power which was THE BANK registered.but on the notice of the Plaintiff's interest OF BENGAL in the notes which the transmission and acceptance v. MACLSOD.
