Here in this Court Captain Fenwick is brought forward to answer a charge of contempt the nature of which is that he is likely to bring the qdminitration of justice in this country into Contempt--that he is likely to weaken the faith of the people in the due and true administration of justice. [...] Would that be satisfactory to the public P Will a decision like that strengthen the faith of the public in the administration of the justice in the same way as a decision' of a Jury ill. [...] Court ; if it was imperatively necessary for the Court to proceed in the manner it had done I would be the first to say regardless of any outside opinion which might be entertained outside -- Go on and exercise your jurisdiction." The jrisdiction is vested in the Court for the benefit of the mast of the subjects and Mud be exercised. [...] In the case of Faulner alluded to before and reported in Montague and Ayrton it is held that whatever might be the right or the power of attachment the Judge who professed to exercise the power had not the power. [...] THE CHIRP JusTicn.—If the contempt is one which does not come under the provisions of the Penal Code there is nothing to prevent the Court dealing with it as a contempt and if it is acontempt. punishable under. the Penal Code the Court.cau try it itself but upon the Understandinc b that the punisment to be inflicted will in no case exceed that provided in the Penal Code.
