R 10 (gym: Pleas 542 that the Court in the district of B had jurisdiction to try the suit on the ground that the cause of action must be deemed to arise at the place where the performance of a contract oug [...] In a suit by the appellants who derived title from the said grantor to annul the mokurari tenure claiined by the respondents : Held that the grant to the ancestors of the respondents was not of an -indefinite nature enuring only for the life of the grantee but passed to his heirs the whole interest of the grantor. [...] Held by the Judicial Committee that in the absence of A and the refusal to allow him to be examined to rebut the plaintiff's case and considering the inconclusive and unsatisfactory nature of the 'evidence coupled with the long delay in bringing the suit such decree of confirmation could not be maintained and the sentences reversed with costs in the Courts below and on appeal.
