An assignment from the persons known as the urallers of the Trachasamana pagoda and its subordinate chetroons to the appellant of the right of matgement therefOr was held to be beyond the legal competence of the urallers both under the common law of India and the usage of the foundation. [...] Another judgmencreditor who had obtained a decree in a separate suit against the estate brought a suit against the purchaser to set aside the sale on the ground that the purchase was not bond fide being made in collusion with the judgment-debtors: Held on the evidence that the onus probandi was on the plaintiff to establish the affirmative issue that the money for the purchase of the taluk was [...] A suit upon a promissory note executed in the district of D and payable in the district of B was brolight in the latter district : Held on the principle laid down.in Vaughan v. Weldon L. R 10 (gym: Pleas 542 that the Court in the district of B had jurisdiction to try the suit on the ground that the cause of action must be deemed to arise at the place where the performance of a contract oug [...] In a suit by the appellants who derived title from the said grantor to annul the mokurari tenure claiined by the respondents : Held that the grant to the ancestors of the respondents was not of an -indefinite nature enuring only for the life of the grantee but passed to his heirs the whole interest of the grantor. [...] Held by the Judicial Committee that in the absence of A and the refusal to allow him to be examined to rebut the plaintiff's case and considering the inconclusive and unsatisfactory nature of the 'evidence coupled with the long delay in bringing the suit such decree of confirmation could not be maintained and the sentences reversed with costs in the Courts below and on appeal.
