The Pundit protesting against acts done under the influence of prejudice or resentment proceeded to say that subject to the instruments the control of the whole in default of male issue devolves on the widow of the deceased ; and there is no authority for dividing the property between her and the daughters-in-law witout her consent. Upon the case referred and consideration of the law it appears to us that the right of Wagdan " or betrothing a girl and of marrying her after belongs in the first instance to the father ; if he be not living then to the paternal grandfather ; failing him to the brother of the girl ; if she have no brother to her paternal uncle ; in default of such relation to her male cous [...] The match being a suitable one and the Defendant having received from the Plaintiff a sum of money toward the expense of the marriage on refusal of the Defendant the magistrate should send for the father of the girl and make him perform his contract.
