One of the innovttions introduced by our courts is worthy of special notice in consequence of its being a deve lopment of law which is not only in conformity with catur justice and in accordance NAth the natural course of lega growth and progress but is also agreeable to the sentiment of the Hindus. [...] The Sections I to VII of Cluipter II of Colebrooke's translation of the 1Vlitrikallarti d;al with Succiension to a is estate and are a-running commentaron t'he text of Yajnvalkya cited in Section I paragraph 2 whicklayji dovensehe order of Succession and in villich the gentiles the cognates a pupil nd a fellow-student " are declared to bekme heirs in their order. [...] The sixth Section of the second chapter of the Mittikshara explains the succession of " the dognatos " ; and the seventh Section deals with succession in default of " the cognates." The opening words of the original of this Section are —"timitTq 'NITA larwri: l akrfffir fvuni &c." —which litoerally mean —"In default of ' the cognates the preceptor (inherits) ; on failure of him the pupil &c." [...] As the students are mostly Hindus I hav directed my effort; to set forth the reasons in support such of the'Hindu customs and usages as aroat varian with those of the civilized countries of Europe in hope that 'tile students may be in a position to form idea of the true character of those customs and usages. [...] References have been given to all the leading cases on the subject of Hindu Law; a complete digest of eases is not within the scope of this work ; a selection has accordingly been made and generally the latest on a point has'been given the perusal of which will enable the reader to find out the earlier ones.
