Before a Magistrate can authorize the detention of the accused person in any custody whatever pending the completion of the police investigation he must peruse the copy of the entries15 [1-6 in the diary relating to the case which must accompany the accused and ascertain why further detention of the accused is cosidered necessary. [...] It is not the duty of the police Nto assemble examine and bind over the witnesses for the defence; nor are the witnesses for the defence to he sent up with the accused and the witnesses for the prosecution. [...] The recent amendment of section 162 of the Code of Criminal Procedure while it prevents the use of statements made to the police for any purpose at any inquiry or trial except to the extent indicated in the proviso to the section should not prevent Magistrates from reading them before the commencement of a trial in order to obtain a general knowledge of the fas11. [...] The result of the examination together with the Medical officer's opinion on the case will be attached to the chalan and the name of the Medical officer will be included in the list of witnesses. [...] In order to ensure that the deposition may in all cases be admissible under section 509 of the Code the Magistrate must sign at the foot of it a certificate in the folloing form :- The foregoing deposition was taken in the presence of the accused who had an opportunity of cross-examining the witness.
