Next it should be observed that the domin4ing purpose in construing a statute is of ascertaiing the real intention of the legislature and that the statute must be construed by reading the several sections therein as a whole so as to give regard to the intention of the legislature and as far as possible to make the statute effective and intelligible and not so as to defeat the object of the stat [...] given to other considerations such as the productivity of labour the existing level of the national inoome the place of the industry in the national economy the effeCT on the community in general and on the industry in particular etc. [...] "II - Thus in the earlier stages of minimum wage fixation the most important criterion was the needs of the worker so adapted as to be' consistent with the general economic condition of the eountry the national income and the general standard of living in the country and little importance was attached to the principle of ' fair' wage i.e. [...] In the interests of peace as well as on the ground of equity and justice I decide that the Tata's scales of wages should be adopted * An illustration of the principle of giing greater importance to the prevailing fates of wages even when the capacity of the industry to pay justified the fixation of a higher wage rate is provided by the following observations of the Industrial Tribunals in t [...] on the basis of other cosiderations such as the cost of living the standard of living of the workers and the requirements of ensuring to the workers a living wage ; and only thereafter considered whether the financial position of the industry would permit of the payment of the wage fixed by them.
