1938 The Hon'ble the Minister of Justice: Sir the language of clause 16(1 is purely discretionary and it leaves an option to the Provincial Hovernment tc recover the cost of survey from the occupier of the factory if the circumstances make this necessary. [...] (5) During the crushing season the Provincial Government may if it is satisfied that there is likely to be in the area reserved for a factory any quantity of cane available for sale to the occupier of the factory in excess of the quantity for which he is required to enter into agrements direct that cane shall not be purchased outside the reserved area until the occupier of the factory enters [...] (5) It the cane-growers or Caue.growers' Co-operative Societies in the assigned area are not willing to enter into agreements to supply or fail to suoply the requisite quantity of cane the occupier of the factory or the purchasing agent may after giving the prescribed notice to the Collector purchase the balance of the carte required from outside the assigned area unless other wise directed by t [...] in the case of a private company any one of the share holders thereof may be prosecuted and punished under this Act for any offence for which the occupier of the factory is punishable : Provided that the company may give notice to the Collector that it haanominated a director or in the case of a private company a sharholder to be the occupier of the factory for the purposes of this Act and [...] Government cannot deny the fact that the analogous Act is as much their doing as of the Government of the sister province the responsibility for passing that Act is theirs and if any loss is caused to the sugar industry the responsibility would be of the Goverments of the two provinces but so far as we on this side of the House are concerned it is our duty to place what we consider proper
