The Company on the other hand maintained that the claim of the Union on tfie heads of gratuity and leave was unreasonable and that the final terms of settlement as suggested by the Labour Directorate on these questions. [...] The dispute as to the leave rules and gratuity is the only outstanding dispute between the parties at the present moment and the Tribunal is competent to adjudicate thereon when it is referred to it by the appropriate Government under section 10 of the Industrial Disputes Act. [...] want to get the advantage of the direction as to unlimited accumulation of privilege leave in case of refusal of.such leave as mentioned above: If the privilege leave of any workman is refused on the ground that more than one-fourth of the workmen in the establishment had applied for privilege leave ien the cdurse of the same month such refusal shall not be a ground for accumultion of the pri [...] The Company as well as the - Conciliation Officer suggested for the 'introduction of a scheme of gratuity on the following terms until the scheme of provident fund is introduced for the workmen of the Company!— 1. Half month's pay (in force at the time) multiplied by the number of complete years of continuous service in the case of— (a) Death while in service."PART THE CALCUTTA GAZETTE EXTRY. [...] APRIL 24 1950 [PART I If and when the system of Contributory Provident Fund is introduced by the Company for the benefit of the employees the scheme of -gratuity set forth above shall not apply for that portion of the period of service of an employee as may be covered by the scheme of the Contributory Provident Fund.
