The subject-matter of the present reference in the nature of an off-shoot of the first reference was also being dealt with simultaneously with that of the main dispute in anticipation of an order of the High Court of Calcutta discharging the Rule issued in connection with the present reference in the light of the recent judgment of the Federal Court of India. [...] I may now proceed to discuss the issues framed in the present proceedings and to determine which of them are really relevant for our present purposes in view of the developments which have since taken place in the light of the judgments of the Calcutta High Court and of the Federal Court of India and of the terms of settlement which have since been adopted by the parties by way of mutual agreement [...] As regards the assessment of the "unemployment period" portion of the compensation the position appears to me to be complicated because of the obvious unwillingness of most of the employees concerned to give out truthfully the actual periods of unemployment. [...] The result of this discussion was that on the 6th July 1949 a joint petition to the Tribunal incorporating the names of 19 employees signed by the President and the Assistant Secretary of the Union and by 'Counsel for the Companies was 'submitted to the Tribunal. [...] The "unemployment period" portion of the compensation shall be assessed in accordance with the chart given in the preceding paragraph it being particularly noted that the expression "total emolument" for the purposes of the "uemployment period" portion of the compensation shall mean the latest total emolument consisting of the basic wages the dearness allowance and children's allowance if an
