In this suit the Platntiff who was the widow of the deceased applied for an order that the letters of administration to the estate of the deceased granted to. [...] He put in a petition before the Court of Sessions for postponement of the hearing of the case and notified his intention of moving the High Court for a tranfer of the case and the case was adjourned to the next Sessions. [...] (c) of the Code of Criminal Procedure so as to enable the accused person to object to that Magistrate proceeding further in the case still this rule should be followed only by placing the two persons under trial together in the same case or on the same evidence; but this rule should not be applied to a case like the present where the trial of the second accused is not on the same evidence on wh [...] That silence on the part of the accused to take any objection as to the trial by the Magistrate in the face of the law requiring him to inform the accused of his right to object to the trial by such 'Magistrate cannot prejudice him and that there cannot be any waiver of his right in such a case. [...] The law offiders in Bengal have advised that the effect of this section is to make no part of a loan where the agreement is to advance it by instalments repayable till after the last instalment has been advanced the consequence being that in the event of such last instalment not being accepted the right of the Goverment to recover the amount of the earlier instalments actually advanced doe
