The Courts below upheld the conveyance and deposits of shares as against the general creditors on the ground that the object of Prance was not to prefer certain of his creditors to others but to shield himself from the consequences of his breach of trust and that there was no fraudulent preference within the meaning of the said section Bankruptcy Act 1.883. [...] The question whether there is a fraudulent preference depends not only upon whether the consequence of the debtor's act is a preference of the creditor but upon the state of mind of the debtor who prefers the creditor.
