The charge upon which the accused wbre triad made no mention of the land of Kamala Bibi and referred to the taking of paddy from the land of Burka Ali as the common object of the unlawful assembly. [...] 298 of the Code of Criminal Procedure allows the Judge to express to the jury his opinion upon any question of fact and that although the Judge in this case used a form of expression somewhat liable to mislead such misleaing effect was counterbalanced by the concluding portion of the charge in which the Judge told the jury that the questions of fact were entirely for them to decide. [...] The Assistant Magistrate however held on the evdence that the passengers had entered the boat beyond the limits of two miles that therefore they would not come within the terms of the Municipal Act and consequently the demanding and obtaiing payment of tolls from them by the servants of the Municipal ferrymen and their detention until such payments were made constituted the offence of wr [...] On appeal the District Magistrate held that he was bound to follow a judgment in a precisely sifnildr ease delivered by the Sessions Judge in which that officer had held that the crossing of the bar of the mouth of the khal so as to enter the Karnafuli river and to land passengers on the opposite bank consttuted a breach of the Municipal Act.
