Owing to the frequency of the commission of this offence by low class Mahomedans chiefly in the Mymensing district the Judges of the Calcutta High Court have recommended and the Legislture has adopted the present amendment. [...] In the wilderness of the codified law of the 'Iraqions Indian Legislatures there is no knowing that the juvenile Magistrates might not unnecessarily wound the susceptibilities of the people by making an injudicious use of tho ratan. [...] Besides notes of cases extracts from the reports of the Rent Commission and that of the Select Committee..-the minutes of the Hon'ble Judges of the High Court and the speeches and debates of the Hon'ble members in Council have been added so as to remove obscurity of the text. [...] The Appeal Court said that a Limited Liability Company as a legal entity was of itself no doubt incapable of malice but malice can be deduced from the acts of their servants and officials not only from the acts and conduct of the Directors but of the other servants and agents of the Company while acting within the scope of their authority and charged with the institution of the prosecution. [...] The suggestion of the llefendants' counsel that the Court had merely to take into account the state of ?hind of the Directors could not be maintained.
