But the Code of Criminal Procedure seems to have presented difficulties toward the adoption of any uniform practice as to the proper course to be pursued by an Appellate Court when taking exception to the verdict of a jury on the ground of misdirection. [...] Often one of the conspirators remarks significantly to the others that the suit involves questions of fact of too much intricacy for the jury or matters of law wholly unsfhted to the facuItiek of a judge and the justice of this view is generally at' once allowed by the Court. [...] Their contention was that the said indenture authorized their removing the whole of the coal notwithstanding that in so doing the natural surface of the land was injured for which they would have to provide compensation for the damage caused that Weed such witt the mode of winning the coal adopted and carried on at the date of the indenture the method its vogue in the Sharlston estate. [...] The real position is that in this case no property was transferred to and vested in trustees at the time of the marriage in which this is finless moldy done in marriage settlementS and' that finless the estates themselves can be treated as having been properly settled " within the meaning of the section there is no property as to the application of which the Court should make any o [...] The argument that it did so and that the 3rd section of the later Act of 1878 in extending die powers of the Court to cases where there arc no children of the /marriage only did so with reference to the class Of marriages contemplated by the said fifth section placed a restricted meaning on the first words of the said sec.
