that though there was a primrl facie case for an alteration of the law the framers of the Bill had borne in mind the necessities of commerce and had not been unmindful of the advantage to the community of continuing to encourage the service of of Criminal Procedure as. [...] It was pointed out that in this last-mentioned case there was one door opening on the street and one staircase common to the occupiers of all the suites of rooms into which the building was divided wheras in the present case each portion of the building had a separate entrance from the street and no part of the building used in common by the occupiers of the ground floor and the first floor a [...] The Registrar in Making the order of referenee directed that the costs of the action should abide the event of the award leaving the costs of the reference and award at the discretiOn of the arbitrator. [...] This was an application to set aside the order of the District Magistrate of the 24-Pergunnahs dated the 27th April 1900 transferring a case then pending in the Court of the Sub-Divisional Magistrate of Bashirhat to the Court of the Joint Magistrate of Alipur and also against the order of the Joint Magitrate of Alipur dated the 3rd May 1900. [...] the latter not being made a party to the suit brought by the Plaintiff against the mortgagors when the Defendant's mort gage was in existence and the Defendant having purchased the equity of redemption before either of the sales at which the Plaintiff purchased and before the date of the Plaintiff's second decree.
