It was urged that the marriage was valid if so they were the children of the testatrix's daughter according t the strictest construction of the word and also that assuming the invalidity of the marriage on a propei understanding of the language of the Will they were included under the word "children." His Lorship held that the words " issue " and " children " were used in their proper legal [...] Their Lordships held that both the letter and the spirit of the Limitation Act required that the suit when looked on as a suit to set aside the sale should fall within the prohibition of the article. [...] The first Court held that the Plaintiffs had proved that they were the sapindas of Munnu Singh that they had established the custom also by virtue of the Wajib-ul-urze they had filed and the oral evidence and the pedigree table they had filed and that after confiscation there was a release of the property and the settlement was with Gulab Kunwar as a Hindu widow. [...] 394 and 395 of the Civil Procedure..rode of the dealings and transactions between the parties to the suit and that in taking the said accounts the Defendant be debited with the amount of the sixteen promissory notes sued upon and interest thereon until satisfaction by the realisation from the timber received by Plaintiff and that the Defendant be credited out of the proceeds of the timber mar [...] from such decision said :- " It is supported not only by the probabilities of the case but by the evidence and we think that the conclusion arrived at by the learned Judge i's correct and that the Defendant is entitled to the account ordered."
