The author complains of the indefinite character of the existing materials with which he had to deal but we must congratlate him on the success of his attempt to bring them under well-defined and appropriate heads The author has given us a translation of certain portions of the Mann Thara Shwe Myin and also the leading cases on the subject. [...] Against this order the judgment-debtor Pettioner preferred an appeal to the High Court which is still pending in this Court and pending the heaing of the said appeal he moved this Court and obtained this rule calling upon the opposite party to show cause why execution of the decree should not - be stayed until the disposal of the appeal by the High Court upon the Petitioner's furnishing a [...] The allegations of the Plaintiff material to this report were that Plaintiff purchased the lands at an exection sale in the benami of Ram Bilajh Singh who subsequently executtd a deed of relinquishmeut in favour of the Plaintiff on the 27th December 1886 ; that in a settlement proceeding the Settlement Officer entered 3 bighas 1 cottah 1 d. of laud in the name of the Plaintiff and the remaind [...] held--That the recognition of the Plaintiff by the landlord as tenant to a portion of the holding is not sufficient to proVe the custow of transfeability. [...] The Court in delivering judgment held :- That where the Plaintiff and the Defendantwere the joint owners of a certain property but the Plaintiff alone was owner of another prperty and the Defendants had no share in the latter and by an oral arrangement not reduced into writing the Plaintiff alleged be got the former property in its entirety and the Defendants got their share in the latt
