RALEIGH PRESENTED THE REPORT of the Select Committee on the Bill to amend the Code of Civil Procedure at last Friday’s meeting of the Legislative Council to the Government of India.- The Bill was referred to a Committee eCrly this session and notwithstanding the bulk of the Bill and the magnitude of the distractions of the Delhi Durbar the Committee somehow managed to revise the Bill during the s [...] 193 463 and 471 I. P. C.) should be sent to the Magistrate and that the Magistrate should inquire into the matter and in May 1885 one of the accused applied to the Ditrict Court to revoke the sanction on the ground that the "sanction " had expired on the 2nd Feruary 1885 and had ceased to have effect!: Held—By the Full Bench that the Munsif's order whether it was or was nct a sanction [...] P. C and he'sent an information to the Magistrate of what had happened and the latter despatched an Inspector to the scene to take the statement of the attaching officer as the first iformation and to send it to him so as to enable him to take proceedings it was held that the prosecution was commenced properly. [...] The following is the order of reference to the Full Bench by Maclean C J. and Banerjee J. MACLEAN C. J.—Two points are raised upon this appeal : the first is that the suit is not maintainable ; and the second is that if the suit is maintainable the Plaintiff is not entitled to the relief which he seeks. [...] 295 and especially to that portion of it which deals with the distribution of the assets where it speaks Of the judgment-debor' not using the expression the same judgmendebtor ' and to the equitable distribution which is aimed at by the section I am disposed to think that the construction put upon it by the case in 12 Calcutta is too narrow.
