The whole question in an ex parte case is the service of summons and it is a matter of regret that the Subordinate Judicial Officers are not as paticular' about the proof of service as the judges on the Orignal Side of the High Court. [...] Their Lordships held that where a plaint in a suit for rent stated the name of the zemindari that of the mouzah and the jumah and mentioned the juridiction and the fact of ownership by the Defendant the description was sufficient for identification and the plaint should not have been summarily rejected. [...] P. C. include the hearing of an appeal and that the hearing of the appeal from the order of the Munsif refusing sanction was a judicial proceeding within the meaing of the code and consequently that under the provisibn of sec. [...] On the 3rd of February and 10th February 1902 the Registrar settled the notification of sale and included therein the properties allotted to the Defendant under the award in lieu of his shares of the immoveable properties as comprised in the mortgage. [...] On the 31st March 1903 the attorneys for the purchasers of the lots already sold raised objection to the sale order of the 3rd July 1901 as defective inasmuch as the properties sold were other than those specifically referred to in the mortgage-deed and desired that the said sale order be rectified and the sale 'held under the said order be held valid.
