The initiation of the sanction of the Court orignates from any of the parties to the agreement aplying that the agreement be filed in Court. [...] (2) Whether there was any and what illegality apparent on the face of the award ? (3) Whether the proceedings conducted by the arbitrators are illegal '? It has been held that the objections taken by the Defendant which were the subject of the above issues precluded the Court frtni filing the award. [...] They then affirmed the finding of the Lower Court on the evidence that " the ship was sent to sea with an -incompetent Allister " In doing so they referred to the invalid certificate as casting upon the Appellants the onus of proving competency the entire absence of evidence to that effect and the fact that the Master had neverabeen in chaPge of a steamer before he took 'charge of the " Ambiina.
