also heard the appeal from the civil decree on the same day (19th August 1902)4 The District Judge had ordered the revocation of the probate on the ground (1) that owing to the death of the testator's son and the widow of the testator not having adopted as directed in the Will she became owner of the property and consequently the grant sof the probate became inoperative ; (2) that the testators ha [...] On the first ground their Lordships held that a grant of probate is decisive only of the genuineness of the Will propounded and of the right of the executors thereby appointed to represent the estate of the testators. [...] This was done after the execution of the mortgage by the lessee to the predecessors of Dfendants the mortgage being of the land together with the fixtures thereon. [...] By the hire agreement the lessee of the factory was to make certain periodical payments for the hire and upon the whole of such having been duly made the machinery and apparatus so hired were to become the property of the lessee : and it was stipulated that on certain events happening the Plaintiff retained the right to repossess himself of the same. [...] On the Plaintiff's appeal the argument that the mode and object of the fixing to the land must be considered and the point for decsion should have been left to the jury did not find favour with the Court of Appeal.
