The Master of the Rolls said the other Judges of the Court of Appeal had been consulted and they were all of opinion that when they were dealing as a Court of Appeal with the decision of a tribunal comprising a Judge assisted by an assessor to sufficiently appreciate the decision of the Judge so arrived at the opinion of the assessor given to the Judge should be considered. [...] 50 The Court of Appeal below has found that an agreement was made between the Plaintiff and the first Defendant under which the sister of the latter was to be married to the former that the second Defendant was no parry to the agreement that Rs. [...] It appears from the judgment of the lower Courts that the Defendant after the expiry of the ijara paid rents to Karnnmoni but when the Plaintiffs purchased her interest the payment of rents ceased. [...] In May 1903 the execution of the decree was stayed by the Court on condition that a further 2 annas of his property was to be brought in by the nmrgagor in addition to the 8 annas already mortgaged to secure the judgment-creditor from loss owing to the stay of execution and the High Court hy its order dated the 23rd May 1901 directed that 10 annas of the properties should be entered in the sa [...] On the day fixed for the sale of the properties the judgment-debtor made an application for the postponement of the sale to a certain date saying that if the sale be held on i hat date he would not raise any objection on the ground of irregularity in the publication of the sale prclamation.
