In regard to objection 1 the said Court held that the payments referred to being of date subsequent to the date up to which a rendition of accounts was sought for in the plaint the question raised could not he considered in [...] The Plaintiff appealed to the High Court on the ground amongst others that it was open to him to apply to the Court which made the decree and in which the assets were to be realized without a formal re-transfer of the decree.
