The books of account for the whole of the period in suit having been lodged in Court the Appellant by petition dated the 16th August 1898 took objetion to ten specific items in the said accounts and on the 17th August 1898 the Respondent filed a written avwer to ea [...] As to the specific objections to the accounts the said Court decided that the Subordinate Judge had rightly disallowed the Appelant's contentious in regard to items 2 to 9. In regard to objection 1 the said Court held that the payments referred to being of date subsequent to the date up to which a rendition of accounts was sought for in the plaint the question raised could not he considered in [...] The Plaintiff appealed to the High Court on the ground amongst others that it was open to him to apply to the Court which made the decree and in which the assets were to be realized without a formal re-transfer of the decree.
