The Defendant filed his written statement on the 21st January 1903 challenging the Plaintiff's title and stating that the Defendant had acted under the orders of the Resident in evicting the Plaintiff fo4 breach of the conditions of the grant. [...] The Plaintiff desiring to have his snit tried in the High Court of Bombay applied to that Court on the 16th March 1903 for the transfer of the suit to that Court on the ground that the snit ought not to be tried by the Political Resident at Aden; on account of his having ordered the dispossession of the said original Plaintiff. [...] The ground of the applcation is that the opponent has in his written statment in the suit sought to justify the act complained of in the plaint as one done under the orders of the Resident. [...] S in the trial of any suit in which the claim shall not exceed one thousand rupees in value the Resident may either of his own motion or on the application of any of the parties refer to this Court any question of law or of usage having the force of law or of the construction of a document affecting the merits of the decision when he entertains reasonable doubt on the question. [...] ln the trial of any suit in which the claim exceeds one thousand rupees in value the Resident of his own motion ?nay and on the application of any of the parties slvril refer " for the decision" of this Court any question of fact or of law or of usage having the force of law or of the construction of a document affecting the merits of the decision.
