The Zemindari Daks Act (VIII of 1862) was passed by the Bengal Legislative Council on the ground that the conveyance of letters on the public service between police-officers and police-stations and the Magisterial offices of the district was "defective irregular and uncertain." Under the Act District Magistrates were authorised to raise the moneys necessary for the payment of the establishments [...] The bond executir(1 by the surety merely provided that he would produce the Appellant when required to do so and so far as the record itself indicates no order to produce the Appellant was issued to the Petitioner till the 30th November and the surety on receipt of that order produced the Appellant within the period fixed in that order. [...] The Munstf dismissed the suit upholding both the contentions of the Defendant ; but the Subordinate Judge on appeal reversed the Munsif's decision and the Defendant therefore appealed to the High Court. [...] The sufficiency of the notice given to the Defenant was challenged on the ground that 6 months according to the British calendar did not intervene between the date of the notice and the end of the year when he was required to give up possession ; and the question arose for decision was whether the 6 months should be calculated according to the Bengali or according to the British calendar. [...] and that the entry as made in the khewat papers was the outcome of a misrepresentation on the part of the landlord and in that view of the matter he refused to give effect to that document and allowed the Plaintiff a decree at the rate mentioned in the etmami pattah.
