If the prprietor of the estate made the remittance in time to reach the Collector on or before the due date he ought not to suffer for any default on the part of the Post Office. [...] Another question in the case though of ruiner importance was whether by bringing the present suit for constrution of the Will the Plaintiff had forfeited his right of residence in certain premises of the testator the testator having provided that the Plaintiff would do so if he "in any manner throws obstacle in the way of this will being proved in Court or objects to any of the provisions [...] When the fraud was dicovered the Plaintiffs were obliged to pay back the £20 000 to the Bankers and brought the action against the Company on the ground that they were Habit for the fraudulent action of their Secretary. [...] Aubyn gave judgment for the Respondent holding that the parol evidence tedered to prove the additional consideration was inamissible on the ground that it contradicted the deed and that the authority given to the Appellant the Attorney was revocable. [...] At the hearing of the rule their Lordships observed :— The complainant's property was stolen and some of the property was found in the floor of the accused covered with earth.
