ACCORDING TO THE PRESENT LAW THE LANDLORD decree-holder is entitled to take out of the surplus sale-proceeds the rent which may have fallen due between the institution of the suit and the date of sale. [...] Under the law the arrears „accruing between the date of sale and the date of confirmation of sale for which the out-going tenant alone is responsible remains a charge on the tenure. [...] As it is not to the interest of the out-going tenant to pay the arrears the liability is in a manner forced on the auction-purchaser who is compelled to pay the arrears to protect his own interest. [...] as to whether the Appellant the Defendant in the suit was entitled to the name he bore or whether he was fraudulently substituted when a boy for the real heir to the property in dispute. [...] The Plaintiffs sued the Defendant Corporation to recover the balance of their outstanding bill relating to the building of the new Municipal offices.
