We hope as we have suggested before that this opportunity will be availed of to silence all hostile criticism on the subject of internments by placing the idividual cases of the persons detained under the Defence of India Act before the Committee and holding the enquiry in the presence of their legal representatives thus giving them an opportunity of testing the evidence adduced by the Crown [...] Referring to the Joni Shaves lengthy judgment Sir Frederick Pollock says it is not clear that many of the things done in the name of the Defence of the Realm Act might not in time of war within the realm be justified in common law. [...] The Code of Civil Procedure provides for the rejection of a plaint when on the face of it it discloses no cause of action the object evdent4y being to save waste of time and avoid useless enquiry; This 'summary power given to Courts is no doubt necessary but at the same tittle it should be exercised with caution and it is the duty of the High Courts not to countenance anything in the procedure [...] The Settlement Officer delivered* judgment on the 23rd August 1912 and in that ordered thgroffice to prepare the schedules shoing the fair rents settled on the basis of the findings and in accordance with the directions given in the judgment. [...] 3 of the Bengal Tenancy Act Part II the period of limitation for appeals To the Court of the District Judge or the Spkial :fudge is 30 days from the decree or order and the schedule is in effect the decree.
