He was a great friend of the late Chief Justice and of many of the Judges of the Calcutta High COurt who succeeded him and also of the late Governor Of Bengal. [...] 128 of the Act by its wording deprives the Court of the power to decide whether or not the legacy was given to the executor. [...] the whole case including the facts is open to the Appellate Court yet where the issue is simple and straightforward and the only question is which set of witnesses is to be believed the -verdict of a Judge trying the case should not be lightly disregarded. [...] The grant of the plant which was in 1809 was in respect of the whole mou 20 and there was a clause in the habullyat reserving to the zemindar the right to appoint or dismiss ehowkidars. [...] The lower Courts held that the clause imports the exclusion of the Chowkidari Chakran lands from the putni : Held—That the clause which reserves to or confers upon the zemindar the right to appoint or dismiss choirkidars has not the effect of rserving to the zemindar and of excluding from the putni the Chowkidari Chakran lands Girish Chandra v. Hem.
