204 the Magistrate issues a summons instead of a warrant are included in the section: The question is has the legislature entirely fettered the hands of the Magistrate in a case in which he has happened to issue a warrant. [...] The Magistrate rejected the application holding that having issued warrants in the first instance (which surely he would have substituted by summons had he been apprised of the real position of the ladies cocerned) he was debarred under the words of the section from granting the relief sought for. [...] I Oiled down the volume of Burke for his encmitun on Mansfield as one whose' ideas went to the growing melioration of the olaw making its lberality keep pace with justice and the actual cocerns of the world—not restricting the infinitely diversified occasions of man and the rules of naturallustice within artificial circumstances but confirming our jurisprudence to the growth of our co [...] The Defendant contested the suit and when it came on for hearing Plaintiff dcovering the ffaistake in the registration of the suit applied to the Munsif who was also the Judge of the Small Cause Court for the registrtion as a rent suit. [...] The Plaintiff thereupon obtained the prsent rule upon the Opposite Party to show cause why the orders referred to above should not be set aside and suchpther order made as to the Court might seem Ell and proper : Held—That it was a question not of 'tranfer of a case from one Court to another but of the rectification of an error in the office of the Court for which Plaintiff was in no way re
