But the drastic provisions introduced in the Defence of India Act for the prevention of breaches of the peace or the commission of grievous crimes punishable under the Indian Penal Code do not seem to be at all required for the successful prosecution the war. [...] One hopes that the modesty which leads the author of the Introduction repeatedly to describe it as an “ essay ” will not obscure its importance in the eyes of scientific students of the eventful epoch whioh saw the beginning as also the cosolidation of the present administrative system of India. [...] The Sessions Judge of Murshidana d referred the case to the High Court with the fallowing opinion :— “ The conviction is bad in law as one of the neees ary ingredients of the offence has not been established and that is that the alleged place 75lxxvi THE CALCUTTA WEEKLY NOTES. [...] IL the terms of his lease give the landlord a right of re-entry in the case of a transfer without the landlord’s consent that may raise a question between the purchaser if any at the Court sale and the landlord but does not clothe the raiyat with a right to object to the sale. [...] deuce it cannot be held that the alleged place of gaming is a public place.' * * The very existence of the mud wall separating the place of gaming from the road is a clear indication of the fact that the place of gaming appertains to some private land and is not a public place ' as part of the road.
